JCSC News: The Cyber Law is here

Dear reader,

If you feel as though I’ve been emailing you about the Cyber Law for a long time, you’re not entirely wrong: I’ve checked and the first time I emailed you with an update on the progress of the Law was February 2024!

In the two and half years since then, we’ve completed two consultations; re-drafted the Law multiple times; briefed States Assembly members; held nine implementation workshops; got States Assembly approval and Royal Assent….and here we are.

If you’ve been involved, thank you. Your feedback has helped us improve the Law so that it remains robust, while also being the right scale for the Island.

I am pleased to confirm that the Minister for Sustainable Economic Development, Deputy Gerald Voisin, has signed a Commencement Order which sets out when the Law will come into effect:

• In September Parts 2 and 3 of the Law come into effect. These parts govern JCSC’s operations and function.

• In December Parts 4 and 5 of the Law will come into effect. These parts identify Operators of Essential Services (OES), and set out the requirements for them.

This means that if you believe you’ll be an OES under the Law, it’s time to start preparing. You should:

• Check whether you meet the thresholds for OES in your sector

• Pre-register as an OES using this form

• Check our website for the latest Advice, Standards, and Guidance.

As I’ve said throughout the development of the Law – I have no desire for JCSC to be a regulator. We know that better cyber security comes best through information sharing, collaboration and support rather than one-size-fits-all requirements.
